Terms of Reference: Short Term Consultancy Services for the provision of SEAH and Integrity Capacity Strengthening Services
1) Summary
Reference: F2A_HR_SEAH_004_2022
Description of the assignment: Faith to Action Network seeks the services of an experienced and qualified consultant to conduct assessments, Develop, roll out, and train Faith to Action Network Secretariat Staff, members and partners on Sexual Exploitation Abuse and Harassment (SEAH and Integrity).
2) Scope of work
The Consultant will undertake the following duties and responsibilities:
- Assess and review Faith to Action Network, its 15 members and partners’ SEAH and integrity policies and practices.
- Support the leadership team in developing and implementing a SEAH and Integrity capacity
strengthening strategy informed by the findings from the SEAH and Integrity audit. - Develop an implementation and monitoring framework for SEAH and Integrity for Faith to Action Network Staff, members and partners.
- Develop capacity development resources and materials on SEAH and Integrity for Faith to Action
Network. - Strengthen the SEAH and Integrity culture within Faith to Action Network programs including but limited to training Faith to Action Network staff, members and partners on SEAH, appropriate conduct for all those involved in Faith to Action Network programmes and how to submit and respond to incidents under the Faith to Action Network reporting mechanisms.
- Develop a standard clause to commit to a zero-tolerance policy on SEA for all Faith to Action Network contracts.
- Together with the HR Dept., review and strengthen recruitment procedures in accordance with local law checking for prior involvement in SEA or other safeguarding concerns.
- Ensure that procedures (such as strict reference checks) are adopted and implemented to avoid hiring people with records of sexual exploitation and abuse-related offenses,
3) Taxes
Faith to Action Network will deduct applicable withholding tax from the professional fees for remittance to the Kenya Revenue Authority as per the applicable tax regulations.
The Consultant is required to avail their PIN or the applicable tax identification number to Faith to Action Network for this purpose.
The Consultant accepts responsibility for all other taxes or fines that may be incurred because of their performance of obligations hereafter.
4) Duration of agreement
It is expected that the working days will not exceed 60 days unless otherwise agreed in writing.
5) Duty station
The consultancy is home-based/ Remote. Interviews shall be held on a need based either virtually or Face to face at the Faith to Action Network offices in Nairobi – Kenya or Stuttgart in Germany.
6) Institutional arrangements
The consultant will work under direct supervision of the Chief Executive Officer. Faith to Action Network will be responsible for providing the consultant with all necessary information related to the service in a timely and transparent manner.
7) Confidentiality and Authorship
The title rights, copyrights and all other rights of whatsoever nature for any data and information under this consultancy are the sole and exclusive property of Faith to Action Network.
The consultant will submit all materials to Faith to Action Network at the end of the consultancy period.
Therefore, not all materials will be disseminated in part or completely without express authority from Faith to Action Network.
The consultant shall not produce information in these materials in any form (electronic, hard copies, etc.) to a third party without a written permission from Faith to Action Network.
8) Payments
Payments for the services will be made upon receipt of an invoice from the consultant and as follows;
- 30 % of the contract sum will be paid at the start of the consultancy after submission of the inception report and approval of the workplan.
- 70 % of the contract sum upon submission and acceptance of the final deliverables.
9) Qualifications and Educational Requirements
- The applicants should have relevant academic background and demonstrating strong experience on safeguarding and SEAH implementation.
- Good theoretical and practical knowledge and understanding on safeguarding and SEAH, familiar
with donor’s safeguarding complains and incident reporting mechanism - The applicants must have extensive expertise in SEAH including rolling out trainings, assessment
and supporting on action plans for Safeguarding and SEAH policies, procedures and compliances for non-profits and civil society organizations - The applicants should have 5 years of experience in international development specializing in
safeguarding and protection issues. Experience working with faith-based organisation will be an
added advantage. - The applicants should be familiar with the legislations and policies governing international non –
governmental organizations and the best practices in management of different types INGOS - Fluency in written and spoken English with excellent communication, facilitation and writing skills
10) Proposal
Interested companies / firms / consultants must submit the following documents / information to demonstrate their qualifications:
Technical Proposal:
- Motivation Letter to Faith to Action Network confirming interest and availability for the assignment, explaining why you are the most suitable for the work
- At least 3 reference/recommendation letters from an organisation/company, mentioning the references’ e-mails addresses and direct phone numbers and willingness to be contacted.
- A list of staff or consultant[s] to be involved in the assignment and their CVs
- A financial proposal presented using the format of Annex 1.
11) How to apply
Proposals should be submitted through email to HR@faithtoactionetwork.org no later than 20th June
2022.
Any request for clarification should be sent in writing to HR @faithtoactionetwork.org.
Note: Faith to Action Network is committed to safeguarding and promoting the welfare of children, young people and vulnerable adults and expects all vendors to share this commitment. Non conformity of violation of this will result in an immediate termination of the consultant’s contract.
